Moving from UK to Spain and Planning For Spanish Tax Residency

When changing tax residency from the UK to Spain, there are potentially costly mistakes that can be made due to not taking advice, or getting the wrong advice, as well as advantages that can be achieved with well advised planning.

Tax in Spain

Most are aware that the Spanish tax system is very different to that of the UK. Income tax allowances vary depending age and whether you have dependents. Tax rates for earned income are higher, and there are different rates for other types or income, such as that from investments or from letting residential property.

You have your non-lucrative visa, and you’re on your way to Spain to start your new life in Spain. Congratulations!

You now start the process of getting yourself registered and set up in Spain.

Here’s our rundown of all the essentials that you’ll need to get done in your first few months of your non-lucrative residency.

Certificado de Empadronamiento

Assuming you already have a place to live, registering on the padron is probably the first administrative procedure that you’ll complete.

The ‘certificado empadronamiento’ or padron as it’s commonly referred to, is the document that confirms your registration in your town halls municipal register of inhabitants.

It’s your proof that you reside at your address in Spain and you’ll need it for every official process that requires proof of your Spanish address, starting with your TIE.

The process varies from one place to the next.

Digital Certificate

The Digital Certificate or ‘Certificado Digital’ in Spanish, is an electronic ID that lets you complete a wide range of administrative processes online using your computer, tablet or phone. You can use it to access all local, regional and national online services, like tax and social security, manage and update your information, complete applications and in many places get an up to date copy of your ‘padron certificate’.

Whilst the certificate gives you access to a lot of things and can be used to complete a lot of procedures such as submitting you non-lucrative residency renewal and tax return, etc, you need to know your way around the systems to be able to use it. Many people allow their lawyer, accountant, gestoria or someone else that they trust to hold their certificate and authorise them to use it to complete procedures on their behalf.

The Digital Certificate can also be used to set up notifications. This is very important, given that the post is so slow and unreliable in Spain. With digital notifications, you’ll never miss an official letter, e.g. from the tax office or town hall, or traffic fine.

There are various types of digital certificates available. The ones most commonly used are the ‘Clave‘ and the one issued by the FNMT. You download it onto device, and one installed you are ready to go.

In some provinces, a digital certificate is now required to book the appointment and more provinces seem to be going this way. This is another reason why getting the digital certificate is one of the first things you need to do.

We usually arrange the set up of the digital certificate at the same time as the padron, as it requires and ID verification which can be done at the town hall.

Tarjeta de Identidad Extranjero

Once you’ve registered on the ‘padron’ you apply for your foreigners ID card or TIE as it’s known.

The TIE application process is relatively straight forward, however some provinces have significant shortages of appointments at the Foreigners Offices or National Police Stations which handle the issue of the cards. Due to this, the one month deadline for applying after your arrival is not enforced.

At the Police station they check you visa, residency approval, and passport stamps, scan your fingerprints and give you a document called a ‘resguardo’ which is your proof that you’ve done your TIE application. The card is ready to collect in around 4 to 5 weeks, at which time you return with your ‘resguardo’ and passport to collect your card.

With your TIE in hand you can move onto getting other things done which require proof that you are resident in Spain.

Spanish Driving Licence

You can use your UK licence for up to 6 months after you have obtained you TIE. Once you have your TIE you can exchange your UK licence for a Spanish one. You can use a gestoria to handle this for your, but the best way to do the exchange is by going directly to the driver and vehicle licencing directorate, DGT, often referred to as ‘trafico‘.

The DGT provides info on their website about the process. You’ll need to complete a basic medical, an up to date padron certificate, your passport, application and signature capture form, and a small photo the same as you had for your TIE. When you have everything ready, you book and appointment at ‘trafico’ through their online system.

Importing and Registering a Vehicle

If you have brought or are bringing you car or vehicles from the UK, the process for this can start once your have registered on the ‘padron’. The first thing that has to be done is clearing customs, and as you are bring your vehicle/s because you are moving to Spain, you’ll be able to apply for an exemption from the 21% VAT and 10% customs duty that would otherwise apply.

Spanish Mobile Phone

A Spanish mobile phone number is needed for most online applications in Spain. Large providers such as Vodafone cater well for English speaking customers, and if you want to get a number quickly without committing to a contract,we recommend Lobster Mobile, and all in English mobile network.

Euro Bank Account

If you do not already have a Spanish bank account, we recommend that you get one. Lots of things in Spain require a Spanish IBAN (bank account number), and when you come to renew your non-lucrative visa, providing statements for a Spanish bank account showing you day to day spending in Spain will strengthen your application.

To open a bank account as a resident, you will need your passport, TIE and to confirm the origin of funds that will be going into the account, (e.g. pension savings etc).

There are a number of ‘mobile app’ based banks that have sprung up in the last few years. These can be opened quite easily using a smartphone. Some like Revolut give you a Spanish IBAN, other give you an EU IBAN, and you can opt for a physical debit card or just have a virtual one in your app.

Currency Exchange

Most people who have the Non-Lucrative visa have either savings in the UK or pension income paid to them in pounds. There are many currency exchange companies offering better deals that most banks, and now there are also a large number of fintech banks like Wise and Revolut, that make changing currency and spending in different countries easy and very low cost.

If you haven’t done so already, get an online account, or open and account with an exchange provider such as A Place In The Sun Currency or Money Corp, to make changing your pound to euros’ easy and get the best rate.

Healthcare

Private Medical Insurance – If you have private healthcare, check where the Dr’s and medical centres are in your area that are on your policy providers list, so that when you need attention, you know where to go and don’t go one which isn’t covered by you provider.

S1 NHS Certificate – If you have the S1, you can complete the application to register it with the social security as soon as you get your TIE. The registration takes around 3 months, and one that is done you can enroll at your local healthcentre ‘centro de salud‘ and GP.

In either case, locating an English speaking medical centre or GP if there is one in your area, will be useful when you need medical attention.

Financial & Tax

Aside from getting banking and currency arrangements set up, there are a few things financial and tax that you need to do or be aware of.

Notifying HMRC of Leaving the UK

Mentioned in the section about bringing a car to Spain, you notify HMRC that you have left the UK by filling in form P85.

Update Your Tax Status With The Spanish Tax Office

Your tax status should be updated to ‘resident’. This can be done by using your digital certificate to complete form 030. This is important if you owned a property as a non-resident, so the tax office no that you are no longer liable to pay non-residents tax.

Overseas Assets Declaration

If you have savings, investments or property in the UK that are worth more than the equivalent of €50k, you’ll need to complete and overseas assets declaration – Modelo 720 in March of the following year after you moved to Spain.

Tax Return

Your first tax return will be due in June the year following the end of your first tax year in Spain. Read more about completing your tax return and tax in Spain.

Planning for Tax In Spain

This should have started before you moved, i.e. understanding what tax you will pay as a resident in Spain and optimising your financial affairs where possible for Spanish tax. If you have not started planning for tax in Spain and have either a personal pension, investments or savings, we recommend that you speak to one of our Financial & Tax consultants.

Preparing for Your Non-Lucrative Residency Renewal

If you only just arrived in Spain with your non-lucrative visa, it mighty seem a bit premature to be thinking about the renewal, but it will come round quickly, and there are some key things to be aware of during your first year to help you get a speedy approval when you renew. The main things that hold up renewal applications are:

Lack of Evidence of Living in Spain

Immigration expect to see a day to day living expenditure in Spain in you current account, preferably a Spanish bank account. Use you bank card to pay for everything you spend in Spain in your first year.

Missing Border Control Stamps

Make sure that if you visit the UK or travel outside of the Schengen area and are stamped out, that you get stamped back in when you return. Keep boarding passes in cases stamps are missed.

Taxes in Spain Not up to Date

The most common cause of an issue here is unpaid non-resident property tax where renewal applicants owned a property as a holiday home before getting their non-lucrative visa, and were not even aware that they should have been paying this tax.

Gap in Healthcare

This can happen when changing Private Medical Insurance provider or switching to state healthcare, e.g. via the S1. It is important to make sure you do not have any gap in your healthcare cover.

This list is intended as a basic guide for the main things that most new non-lucrative residents need to do and think about in their first 6 months in Spain. Of course everyone’s situation is different and along with everything here there will likely be many other things on your getting set up in Spain checklist. The above is hopefully a good starting point for you.

Extranjeria Foreigners Office for TIE Applications

The TIE, Tarjeta de Indentidad de Extranjero, is the Spanish identification card for citizens from third countries (non-EU) who reside in Spain. The Withdrawal Agreement TIE is a special version of this card, issued to British UK nationals who have retained EU rights under the terms of the Brexit Withdrawal Agreement.

The qualifying requirements for applicants e.g. for proof of means remain the same as they were when the UK was in the EU. British UK nationals living in Spain who had not obtained a residency certificate, had until the 31st December 2020 to apply for the the Withdrawal Agreement TIE.

You can now apply for the Withdrawal Agreement TIE in these circumstances:

There are two main healthcare requirements for the Non-Lucrative Visa. Firstly you must be free from any of the diseases listed under the International Health Regulations 2005, and secondly you need to have unrestricted access to healthcare in Spain.

Doctors Letter or Medical Certificate for a Non-Lucrative Visa Application

The first requirement is satisfied by obtaining a Doctors letter or medical certificate. The Doctors letter or medical certificate can be provided by your own GP, or a private Doctor either in the UK or Spain. The letter or certificate has to be signed by the issuing doctor, have their medical practice stamp, and their registration number. In the UK this is known as a GMC (General Medical Council) number.

The padrón de habitantes, is a municipal register of inhabitants maintained by the town hall.

All full-time resident in Spain are required by law to register on the ‘padrón’, and certificate is the most widely accepted official proof of address.

If you’ve arrived in Spain with a residency visa, it’s one of, if not the first things you’ll need to do, as you need the registration certificate to apply for your TIE.

Registering on the ‘padrón’ helps the local town hall to apply for funds from central government to bolster their municipal budgets. More registrants equals more funds. For this reason, many town halls are keen to get more inhabitants to register on their ‘padrón’, and often campaign to persuade more people to do so. In touristic and popular holiday home areas such as the Costa del Sol, these campaigns are often targeted at the high numbers of foreigners who have holiday homes in the locality.

Aside from the potential benefits to the area where you live being registered on the ‘padrón’ is useful for a number of other purposes. These include proof of address, entitlement to local and reduced price services, and eligibility for subsidised rates of locally collected taxes – IBI. For these reasons, many non-resident property owners also register on the ‘padrón’.

This can cause issues for part time residents, if or when they take up full time residency. Town Hall’s will maintain that there are are no tax implications, for being registered, however tax authorities can and do associate being on the with being resident in Spain. For example a holiday home owner who has just become a permanent resident in Spain, may find themselves being denied a exemption from customs or registration taxes when importing their own personal vehicle in Spain, simply because the ‘padrón’ entry shows that the date they first registered pre-dates their actual date of becoming a Spanish resident.

The ‘padrón’ certificate is valid for 3 months and when you need a new certificate, you just go back and get one of if your town hall is on the electronic register system, you can get a up to date one online using your digital certificate. You only have to re-register every 2 or 5 years depending on your situation and nationality.

The process for registering on the ‘padrón’ varies from one place to the next and you may need some or all of the following:

application form
your passport
your TIE / NIE or residency certificate
copy of your Escritura (house deeds)
or Rental contract and utility bill

Most town halls now have an online booking system where you book you appointment first and then go and register.

In a lot towns they issue the certificate straight away, however in some places you have to go back a week or two later to collect it. A few small towns also carry out a check by sending a local police office to visit the address to verify that you are living at there!

The are quite a few steps and costs involved to import and register and car from a non-EU country in Spain.

First and foremost EU conformity, import and registration costs must be taken into account as these can make the import and registration in Spain impossible or too expensive to be worth while.

This said, under EU rules if you are moving from a non-EU country to live in an EU country, such as Spain, you can bring your possessions including cars, and avoid paying the costly duties and taxes and having to pay for expensive EU conformity certification.

These transfer of residence rules give you up to12 months form the date you get your residency to import your car and avoid paying customs and VAT. However you only have 60 days from the date you take up residency, to register your car and avoid registration tax (if it applies).

Importing a high value car from the UK in Spain post Brexit, now comes with added costs. As the UK is no longer in the EU and the standard process to import and register a UK car in Spain now involves customs.

This means on top of the registration tax which in most cases will be 17% of the vehicle value, 10% customs duty and 21% VAT will apply, unless you can find away around it.

Paying nearly £50k to register a £100k motor is simply not a consideration. There are however various ways these huge costs can be avoided, bringing the cost of importing and registering high value cars in Spain down to a few thousand Euros, rather than tens of thousands.

Spain’s Golden Visa offers residency to individuals who make a real estate investment in Spain of €500,000 or more. The Golden Visa scheme has been in existence since September 2013 when legislation for the ‘residency by investment scheme’ was passed. The aim being to attract foreign investors at a time when the economy of Spain was not in a very good place. Since it’s inception, over 25,000 foreign investors have benefited from the scheme.

The scheme is open to nationals from non-EU or third countries, and has so far been most popular with investors from China, Russia and the USA.

What does Spain’s Golden Visa Offer Property Investors?

The TIE, Tarjeta de Identidad de Extranjero, or foreigners ID card, is the Spanish identification card foreign nationals from third countries (non-EU) who reside in Spain.

Once you have arrived in Spain with the relevant residency visa or otherwise meeting the eligibility for a residency permit that is applied for in Spain, you can begin the process to get your foreigners ID card – TIE ,’tarjeta de identidad de extranjero‘.

Applying for the TIE ‘Tarjeta de Identidad de Extranjero’ Foreigners ID Card

Before you can get your TIE you must have a valid residency visa or residency permission. Residency visas are applied for and issued through the Spanish Consulate in your home country, and residency permits are handled by the immigration office in the province where you live in Spain. How and where you apply depends on you situation and the type of residency you qualify for and are applying for.

Once your have your visa or residency permission granted by immigration, you apply for your TIE a National Police Station within the province where you live. The card takes a few weeks to arrive and is collected from the police station when ready.

You can apply in person or appoint a representative or give someone Power of Attorney to apply for a residency permit on your behalf, however with the exception of the ‘Golden Visa’, residency visas have to be applied for in person. The application for the TIE itself, also has to be made in person. You provide your fingerprints and a photograph for your biometric ID card. The whole process can take anything from 3 to 9 months depending on what type of residency you have applied for.

TIE – Spanish Visa & Residency Application Requirements General Info

Visa applications are applied for in person through the Spanish consulate. Applications for residency permission can be done in person or can be submitted online.

The online submission system is works well, and the Spain’s immigration office encourages the use of this system. To submit your application you need to have a digital certificate in place. The digital certificate is and online ID and signature. If you don’t have one, you can authorise someone else or a company to complete the online submission on your behalf.

All TIE residency applications require the following

*Completed EX application form – the form number will vary depending on your situation and type of residency being applied for

Indentification

*Copy of all pages of valid passport / travel document and visa if applicable
*Proof of address in Spain

Healthcare

*Private medical insurance policy / certificate with proof of payment of the policy
*or Proof of social security payments if employed or self employed
*or Proof of other access to healthcare – e.g. state healthcare entitlement

Income / Proof of Financial Means

The exact documents required for proof of financial means varies depending on circumstances. Any of the following as applicable may be required:

*Contract of employment
*Payslips or pension statements
*Bank statements
*Investment statements
*Contract for rental property

Dependant Applicants

*Birth certificate for child / dependant spouse applicants
*Marriage certificate / record of civil partnership for spouse / partner

Official translations of documents that are not in Spanish must be provided.

Additional documents to support your application

The the consulate and immigration when reviewing applications apart from checking qualification and eligibility, may also request further information validating your arrival and situation in Spain.

When your application is received, a receipt will be issued confirming that it has been presented. It will then be reviewed accordingly at the provincial foreigners office. If for any reason your application is not immediately accepted and further information is requested, you have 10 working days to supply the additional information that has been asked for. Applications are archived or rejected if additional information requested is not supplied in within the given time.

Notification of the approval of your application will usually be sent within 3 months, and you have one month to make an appointment and complete the your TIE application at the National Police Station.

TIE Tarjeta de Indentidad de Extranjero Application – Getting Your Card

The second stage of the TIE application process is relatively straight forward, and appointments are readily available in most areas at the Foreigners Offices and National Police Stations.

For your second stage application you need to have a pre-booked appointment.

*EX application form (as with the first stage the form number varies depending on type of visa or residency you have)
*Your visa or residency permit approval notice
*Passport and a copy ( a copy of your passport and the application is acceptable if you are in the process of renewing it)
*Small (carnet size) passport photo 32mmx28mm
*Proof of your Spanish address (padron)
*Modelo 790 form with €12 tax paid and stamped by the bank, or with payment receipt attached

When you present your application at the Police station your fingerprints will be taken electronically and if everything else is in order, you will be given confirmation of your processed application and told to make an appointment to come back and collect your card in 5 to 6 weeks. Some Police stations operate collection without appointment, and just have allocated days or times for collection of TIE cards.

Time was against us with the impending end of the GV, but due to Sam’s tenacious manner, not a piece of our application was left to chance .. I can’t speak highly enough about how the whole process was handled .. We started the process in November and had the application sent off on the 18th Dec . Due to following the precise instructions given to us by Sam on behalf of Lifestyle Services, we found out on the 15th of Jan that we had been successful .. Firstly a big thank you to the Lifestyle team.. deciding to relocate to Spain is a big decision, as soon as you start to research there are 100’s of opinions and suggestions. We found Lifestyle quite quickly and after completing the on line form Simon arranged to speak with us and talked us through the process, what support and the costs are involved. Renewing a driver's license is far more difficult than imagined. The difficulty lies in making an appointment. Every day, DGTs in various cities in the Audalucia Autonomous Region only place a few numbers and they disappear instantly. We found out about Lifestyle Services via a Facebook page dealing with moving to Spain and the Non Lucrative Visa. Even though we felt confident we knew the process, the option of a free initial call was too good to miss and boy am I glad we made that call.From that initial conversation it became obvious that Lifestyle take all the pain away from the NLV process and it was an easy decision to use them. There is enough to do with the process of relocating without some of the hoops you need to jump through for the NLV. They say moving is the most stressful thing you can ever do. Well emigrating is more stressful but thanks to Lifestyle the NLV was a breeze. Simon, Rebecca and all the team have been outstanding throughout the process and no question is too much trouble. At one point I messaged Rebecca with a "stupid comment of the day" question. First line of the answer was, "there are no stupid questions."We now have our Visas but it doesn't end there. Lifestyle are assisting us with the essentials of settling in Spain, TIE, S1 registration etc. Although we have a number of friends in the area we are moving to who would help, we decided to carry on with the "Smooth Ride" with Lifestyle.If you are thing of applying for a Spanish Visa, it's well considering Lifestyle Services. Lifestyle was recommended to us by a family who moved to Spain just a few months prior to us. We did not follow the advice as we were already using a lawyer who was supposed to settle our residency as part of his offer package. It was a huge mistake. If you are new to Spain you are still to learn how hard it is to find someone efficient and reliable, and we paid a heavy price for not going to Lifestyle for the residency permits. Our applications were not submitted on time, they were not submitted in full, mistakes were made that later needed to be rectified, the list went on and on. After that experience we only go to Lifestyle. They sorted our driving licences for us without any hassle, no delays, no mistakes, no issues, clearly explaining the process along the way. A couple of years later they sent us a reminder to have our licences renewed. The communication and efficiency are brilliant, the rates are fair. Do not hesitate using them.

I am just so relieved that I contacted Simon & Rebecca to help me apply for my NLV. They have been such a calming support to me. We used Lifestyle services to help with getting all our documents sorted and translated for our Non Lucrative Visa. We are very pleased with the help and guidance received and I am sure it would have taken us months to do it on our own and we would have given up.There is a lot of paperwork involved and they helped us throughout the process so when we went to BLS London we were well prepared. As we had all the right documents, in the right order, it took just 20 mins to submit our application on the 10th of January and received our visas today ( less than 2 weeks)I can't thank them enough for all their help even at weekends and Christmas break as we were desperate to get the application through.We highly recommend that you use this agency as we know a few people who tried to do it themselves and ended up having to go back to BLS as they didn't have the correct paperwork.

Our first person of Contact was with the manager Simon, he made us feel really at ease, no question was to small for him.He explained everything that we needed to do for our new life in Spain post BREXIT. He was so patient with us. Lifestyle guided us through the Visa application process, arriving in Spain, the Padron, our TIE and even exchanging our driving licences. They also gave us advice with our S1. We have met with most of the team as we now live near the offices. I rang up the other day to get some help. I am buying a new car and the manufacturer I was ordering from said they couldn't register it in my name because I didn't have a Spanish Padron so I called to get help with getting that from Lifestyle. We spoke to Simon in March who checked our circumstances and assured us that we met the requirements to get NLV’s. He advised us of the items and costs involved and sent us their detailed information and confirmed our hoped for date of early July was achievable but obviously with Spanish bureaucracy anything can happen.We returned to UK 27th. March and started the process which unfortunately meant new passports just when the passport office were about to strike. The site for the ACRO reports was down but Rebecca gave us a phone number that got us our police reports.We were quickly helped every time we had a problem ( and we had a few ) and booked our appointments at the consulate in London for Friday May 19th. This appointment was at BLS and was chaotic,I think we were some of first NLV’s processed there in amongst a large numbers of students.Shortly after our interview they queried our S1 health cover and Lifestyle Spain provided copy documents and a covering letter which proved our documents were in order.Friday June 16th our passports with visas were received so 11 weeks and 4 days from arriving in UK and getting NLV’s.It was stressful, but without Rebecca,we would have almost certainly failed just like many people we know and multiple applications are more expensive than seeking professional advice.Thank you Simon,Rebecca and the team without you we would still be struggling.

I cannot recommend Lifestyle La Cala de Mijas highly enough. We moved to France almost 20 years ago and did all the... necessary paperwork ourselves. We decided to buy an apartment at La Cala Golf resort on the spur of the moment. We are from Scotland and needed to get... NIE certificates whilst we are in Spain. We came to Spain 8 months ago today retiring early becuase of BREXIT, and panicking that we would not get residency in... time, after seeing two other agencies whom we had no confidence in and one just wanted our money, we found Lifestyle on FB. I am so impressed with the service, I was applying for my EU residency and it was so easy and straight forward. I want to thank you on behalf of Julie & I for for the most wonderful service, help and assistance.

What really... stands out for Julie and I is the way you handled everything and resolved the set back we had on Thursday 10th September, where Torremolinos Police didn’t have my approval on the system. An error on the part of Spanish Immigration.

Well done, and thanks for the lightning fast response and resolution.

Now I just must say how super impressed we were with Ana.

Ana, you were simply awesome. The very calm, professional, way you dealt with everything was a joy to watch.
Even with the setback, the way you took the opportunity to get Julie’s case dealt with, was very sharp.

Plus, even though you found yourself time critical because of the set back and your impending next appointments in Fuengirola, you were so relaxed and in control.

Very very impressive.

I was about to tell you to abort and head off because it would not have been fair to put your other clients at a disadvantage.

In the end it didn’t come to that because you had built such great rapport with the civilian employee.

You were able to quickly explain that the team at Lifestyles had managed to get the approval, correctly, onto the system AND ensure that he was prepared to deal with my case.

All round, very impressive.
Thanks to the whole team.
